Terms of Service

1. Agreement and Service Provider

These Terms of Service govern access to Dentosh public pages, appointment and patient services, portals, QR verification tools, and related online features made available by Bright Smile Dental Clinic (the Clinic). By creating an account, submitting an appointment or consultation request, or using these services, you agree to these Terms and acknowledge the Clinic Privacy Notice. If you do not agree, do not use the online services.

2. Not an Emergency Service or Medical Advice

Dentosh is not monitored as an emergency service. For severe bleeding, facial trauma, difficulty breathing or swallowing, rapidly increasing swelling, loss of consciousness, or another urgent condition, call 911 or go to the nearest emergency facility. Website information, automated prompts, and AI-assisted pre-consultation content are general support tools. They are not a diagnosis, prescription, or guarantee of treatment. Only a licensed dentist who has appropriately assessed you may provide professional dental advice or treatment.

3. Eligibility and Authority

You must be at least 18 years old and legally able to accept these Terms, or use the service with the involvement and authorization of a parent or legal guardian. If you submit information for another person, you confirm that you are authorized to do so and that the information is accurate.

4. Appointment Requests

An online submission is a request only. An appointment is confirmed only when the Clinic communicates confirmation or its status shows Confirmed. Requested dentists, services, dates, and times remain subject to availability, clinical appropriateness, and Clinic confirmation. You must provide a working contact method, review Clinic messages, arrive at the communicated time, and promptly contact the Clinic to cancel or reschedule. Any deposit, cancellation, late-arrival, or no-show policy disclosed before payment or confirmation forms part of these Terms.

5. Accurate Health and Account Information

You agree to provide complete and accurate information to the best of your knowledge, including allergies, medications, health conditions, pregnancy, and prior treatment relevant to safe care. Update the Clinic when important information changes. Do not impersonate another person or create misleading records. You are responsible for protecting your password, connected Google account, one-time codes, appointment references, prescription QR codes, and devices. Notify the Clinic promptly of suspected unauthorized access.

6. Consultations and Treatment

Online communication may support intake, follow-up, and scheduling but may be insufficient for diagnosis. A dentist may require an in-person examination, imaging, tests, medical clearance, or referral. Treatment options, material risks, alternatives, expected fees, and required consent will be discussed separately when appropriate. Accepting these Terms is not consent to a particular dental procedure.

7. Prescriptions and QR Verification

Prescription records and digital-signature or QR features support authenticity checks. A verification result reflects the Dentosh record available at the time of checking and does not direct a pharmacy to dispense contrary to law or professional judgment. Altering a record, copying it for fraudulent use, or attempting to reuse a cancelled, expired, or another person's prescription is prohibited.

8. Fees, Payments, and Refunds

You are responsible for fees disclosed for requested appointments, consultations, treatment, products, or services. GCash, Maya, banks, and other payment providers operate under their own terms and may charge separate fees. Never send the Clinic your payment PIN or one-time password. Payment is complete only when verified and recorded by the Clinic; a transaction reference alone does not prove receipt. Refunds, deposits, packages, discounts, and cancellations follow the written policy disclosed for the service and applicable Philippine consumer law. Nothing in these Terms waives a right that cannot lawfully be waived.

9. Acceptable Use

You must not access another person's account or records without authority; submit false, harmful, unlawful, or fraudulent information; probe, bypass, disrupt, reverse engineer, overload, or introduce malware into the service; systematically extract data without written permission; violate confidentiality or other rights; or misrepresent any QR result, digital signature, prescription, receipt, or Clinic communication.

10. Third-Party Services

Dentosh may connect to Google Sign-In, maps, communications providers, GCash, Maya, or other services. Your use of them is also governed by their terms and privacy notices. The Clinic is not responsible for a third party's independent service, outage, account decision, or content, but remains responsible for its own obligations when it engages a provider to process data.

11. Intellectual Property

Dentosh software, branding, page design, and original platform content are protected by applicable intellectual-property laws and remain with their respective owners. You receive a limited, personal, non-exclusive, revocable right to use the service for legitimate patient or Clinic-related purposes. Personal and health information remains governed by the Privacy Notice and applicable law.

12. Availability and Changes

The Clinic aims to keep Dentosh available and accurate, but maintenance, connectivity problems, security events, and third-party outages may interrupt it. Features may be modified, suspended, or retired for operational, security, legal, or clinical reasons. When practical, the Clinic will preserve lawful record access and provide notice appropriate to the impact.

13. Suspension or Termination

The Clinic may restrict online access when reasonably necessary to address unlawful use, security risks, nonpayment, threats, or a material breach of these Terms. Restricting portal access does not eliminate patient-record duties, accrued payment obligations, privacy rights, or access rights provided by law.

14. Disclaimers and Responsibility

To the extent permitted by law, online features are provided on an as-available basis and are not guaranteed to be uninterrupted or error-free. The Clinic is not responsible for harm caused solely by inaccurate information supplied by the user, misuse of the service, failure to protect a code or device, or events beyond reasonable control. These Terms do not exclude liability for professional negligence, fraud, willful misconduct, violation of data-protection duties, or responsibility that Philippine law does not permit the Clinic to exclude or limit.

15. Philippine Law and Disputes

These Terms are governed by the laws of the Republic of the Philippines, including applicable data privacy, electronic-commerce, consumer-protection, and health-profession rules. Concerns should first be raised with the Clinic for prompt resolution. You may also approach the appropriate regulator or court. Any venue provision remains subject to mandatory consumer and procedural law.

16. Changes to These Terms

The Clinic may update these Terms to reflect service or legal changes. The updated version will show its effective date. Material changes apply prospectively and may require renewed acceptance. Continued use after proper notice means acceptance of the revised Terms, except where law requires another form of agreement.
